Terms of Service

These Terms of Service govern access to and use of the 水O' Terroir Virtuel platform, published and operated by 水O'-Terroir Virtuel Limited, a Hong Kong company with its registered office in Hong Kong SAR. The platform is currently operated in Hong Kong SAR, where the trademark 水O' — TERROIR VIRTUEL is officially registered (HK IPD No. 306090697, classes 9, 35 and 42). A gradual rollout is planned in Mainland China, Japan and South Korea once the corresponding trademark registrations are granted via the Madrid Protocol (WIPO).

Article 1 - Purpose

The 水O' Terroir Virtuel platform offers HORECA establishments a service to enhance their premium French mineral water and French terroir wine offerings.
Services include: interactive digital menu, QR codes, analytics, AI sommelier.
Access to services is conditional upon subscription.

Article 3 - Intellectual Property

The 水O'™ trademark (水O'-TERROIR VIRTUEL / SHUIO'-TERROIR VIRTUEL) and logo are used by 水O'-Terroir Virtuel Limited (Hong Kong company No. 80362115). An official trademark application with the Hong Kong Intellectual Property Department (classes 9, 35, 42) is pending.
The "Terroir Virtuel" concept, the AI Sommelier algorithm, the water/wine/dish pairing engine, scores, classifications, business rules and recommendation logic are the exclusive property of SHUIO'-Terroir Virtuel Limited.
Any unauthorized reproduction, extraction, reverse engineering, imitation or reuse of these elements is strictly prohibited.
Water and wine illustrations are original AI-generated creations, with no affiliation to third-party brands or appellations.

Article 4 - Liability

水O' does not guarantee the accuracy of analytical data which is provided for informational purposes.
AI Sommelier and Terroir Virtuel recommendations are provided as indicative professional aids only; they are not medical, nutritional, certified oenological, regulatory or contractual advice.
水O' cannot be held liable for indirect damages related to platform use.

Article 5 - Automatic Translation

5.1 Nature of Translation Service

The 水O' platform integrates an AI-assisted automatic translation service for product technical sheets (mineral waters, wines) in 6 languages (French, English, Traditional Chinese, Simplified Chinese, Japanese, Korean).
This service is included in Premium and Elite subscriptions as a commercial communication aid.
Generated translations constitute a comprehension and communication aid, and not a certified, sworn, or legally binding translation.

5.2 Limitation of Liability

水O' does not guarantee in any way the accuracy, completeness, or suitability of automatic translations generated by the platform.
The user acknowledges that automatic translations may contain errors, terminological inaccuracies, or culturally inappropriate nuances, particularly regarding organoleptic descriptions, designations of origin, mandatory legal mentions on wine and water labels.
水O' disclaims all liability for any direct or indirect damage resulting from a translation error, including but not limited to: product label errors, inaccurate allergen information, regulatory non-compliance in an export country.

5.3 User Obligations

The user is solely responsible for verifying and validating translations before any commercial, regulatory, or contractual use.
For any official use (labeling, regulatory documentation, export contracts), the user must engage a certified professional translator.
The user agrees not to use automatic translations as the sole source for regulatory compliance in export jurisdictions (EU, Mainland China, Japan, South Korea, etc.).

5.4 Recommendations

水O' strongly recommends proofreading by a qualified native speaker for target markets, especially for oenological terms and terroir descriptions.
Translations of mandatory legal mentions (allergens, sulfites, alcohol content) must be verified by a professional competent in the regulations of the destination country.
